Naked Politics

Naked politics
grip Malaysia
as corruption watchdog
bites state governor.

After Perak crisis
and paralysis
via political frog hop,
now Selangor suffers
humiliation of one-two punches of nude expose
and corruption watchdog
big power bark~bite.

That's the new naked
bare knuckles tactic
in the last month of
outgoing premier
Datuk Seri Abdullah
Ahmad Badawi
pressured by UMNO leaders to step down
next month ahead
of his earlier planned
exit.

As premier-designate
Datuk Seri Najib Tun Razak
prepares to take over
UMNO leadership
in late March,
we witness
vile devious
political play.

Today
Democratic Action Party(DAP) chairman
Karpal Singh criticizes
Malaysian Anti-Corruption Commission(MACC)
for compromising its independence
and integrity.

Its chief commissioner
Datuk Seri Ahmad Said Hamdan
has literally jumped
into the political fray.

He barks aloud and bites
Selangor Mentri Besar(Chief Minister or State Governor)
Tan Sri Khalid Ibrahim
with claim of "good and strong
evidence" of Khalid's abuse of power
over car maintenance and charity beef gift.

This historic statement
by MACC,set up as an independent body
by Malaysia's Parliament,
seems to be contrary
to its aims and objectives.

One is reminded
of the earlier character assassination
attempt on former deputy premier
Datuk Seri Anwar Ibrahim
via media prosecution.

Now it happens again.

Karpal stresses corruption
watchdog has departed from
its role with such serious allegation
without proper legal process
in court.

In fact, Khalid has already
filed two defamation suits
in Shah Alam High Court
against his predecessor,
discredited ousted former
Selangor Mentri Besar
Datuk Seri Dr. Mohd Khir Toyo.

His lawyer,Sankara Nair,
filed the suits on Wednesday
(February 18,2009).

Khir Toyo,now Selangor
opposition leader and state assemblyman
of Sungei Besar, has alleged
Khalid misused state funds
for maintenance of
his luxury Lexus car
and charity beef gift
distribution from
slaughter of 46 cows
during Hari Raya Aidiladha
celebration at his
Bandar Tun Razak
parliamentary constituency.

Amid severe recession,
Malaysia is hit hard by
horrendous political storm
of wild emotions
and foul furious
terror furore.

In the pursuit of power
by any means,
some political masters
have forgotten
basic human rights,
constitutional law,
fairness and reasonableness.

Naked politics
at its worst
aimed at maximum
damage,defamation
and destruction
are used
without scruples.

This alarming trend
is evident in recent events
as follows:-

*Death threat with two live bullets
sent to Karpal Singh at his home
in Jalan Utama,Penang.

The threat warns karpal that
his family would be burned
to death for fooling around
with Malay rulers and Malay issues.

Karpal had earlier stated
he would sue Perak sultan
for acting ultra vires
Perak Constitution.

*Assassination threat on
Penang Chief Minister
Lim Guan Eng for strong
statements on modern parliamentary
democracy and removal of
immunity of rulers from
being sued by former premier
Tun Dr.Mahathir Mohamed
during Constitutional Crisis.

*Similar death threat on
Perak State Assembly Speaker
V.Sivakumar for chairing
State Assembly Special Privileges
Committee that has issued suspension
orders on National Front Perak Mentri Besar
Datuk Dr. Zambry Abdul Kadir
and his six-member for
contempt of the House.

Acting on complaint
from Canning state assemblyman
Wong Kah Woh,
the panel summoned
Zambry and his exco
to appear before it
at 3.30p.m. on Wednesday
(February 18,2009).

It bars Zambry from
the Perak State Assembly
for 18 months and the others
each for 12 months for
acting "unconstitutionally and
illegally in contempt of the House".

This means National Front
would command only 21 votes
against People alliance 28 votes in any formal sitting of Perak State Assembly.

Sivakumar has ruled the three political frogs
as having resigned and vacated
their seats.

He says Zambry, his exco and the three
political frogs would be thrown out
if they attend the next formal sitting
of the Perak State Assembly.

Meanwhile,ousted People Alliance
Perak Mentri Besar Mohammad Nizar Jamaluddin
says he would vacate
Perak Mentri Besar official residence
today(February 22,2009) to contnue
his fight in Kuala Lumpur.

Nizar and his 10-member exco have filed
constitutional law suit at Kuala Lumpur
High Court to declare Zambry
and his six-member exco "illegal
and unconstitutional".

The five-page suit with
supporting affidavits
from Sivakumar and Nizar
seeks judicial review
to declare Nizar
as the legitimate
Perak Mentri Besar
and an injunction
to stop Zambry
or his agents from
carrying out the duties
and functions of
Mentri Besar.

High Court judicial commissioner
Mohamad Ariff Md Yusof
has offered to recuse himself
from hearing the landmark
constitutional law case to escalate
it to the Federal Court in the interest
of speed
and finality.

His grounds are his previous
involvement in PAS legal matters,
PKR legal issues and National Front's
election petition in Sarawak.

His decision is to preserve justice and
integrity of the court.

Nizar urges the court to disqualify
Perak legal adviser for National Front
Ahmad Kamal Md Shahid from
acting for Zambry
as Zambry is being sued
in his personal capacity,
not as Perak Mentri Besar.

Hence,Zambry
has no right
to make use of
Perak state's resources
including its state legal adviser.

So Perak now
has historic two
Mentris Besar
and two state governments
each claiming legitimacy.

Outgoing premier
Abdullah has urged
Zambry and his exco
to lodge police report
against Sivakumar.

He feels the Perak
State Assembly Speaker
has shown disrespect
to Perak sultan.

First Perak.Now Selangor.
Elizabeth Wong,poor soul,
has fled the country in deep distress and humiliation over the circulation of her nude pictures via MMS and mass media.

As one reviews
the train of events,
one would ask some
vital questions:-

Have we forgotten what makes a society great?

Do decency, justice and right mean anything at all?

Why not solve Perak crisis by calling for fresh state
election?

Can't the people exercise their right to vote for
representatives of their choice in Perak State Assembly?

Well, what's next? Worst moves? More foul play?
And Use of  ISA? Declaration of State of Emergency?

When Government Becomes

When government
becomes the problem,
not the solution,
what do we do?

When it shatters
the public trust,
should we accept it?

When it robs
our present,
must we validate it?

When it spreads
its corruption menace
should we applaud it?

When a coalition
with a party known
for money politics
as its leader
adopts unprincipled
political practices,
should we support it?

Must we
should we
bear the burden
of its blunders
and pay the price
of erosion of our
constitutional human rights,
the deterioration
of our national competitiveness
the destruction
of quality of life,
security,peace
and public law
and the decline
in educational standard
of our schools and universities?

When it grabs
power at a state
without the people consent,
should we keep quiet?

Are there no laws
and principles
to outlaw such open
show of arrogance
such raw usurpation
in our modern society
that practises parliamentary
democracy?

Should we
not all rise up
and condemn
it to safeguard
and preserve
our consititutional right
and freedom
to vote for
representatives of
our choice?

Perak Power Play

Perak power play
enters into Act 2
with two Mentris Besar
performing special functions.

Yesterday(February 7,2009),
newly sworn in Mentri Besar
(Chief Minister or State Governor)
Datuk Dr. Zambry Abdul Kadir
acted out his role
with high profile public relation
exercise by attending
Perak Gerakan
Chinese New Year
open house
at Kampung Simee
in Perak's state capital,
Ipoh.

His ousted protagonist,
Datuk Seri Mohammad Nizar Jamaluddin
chaired special executive council(exco)
meeting
at Perak's Mentri Besar
official residence
at Jalan Raja di-Hilir
5 km. away at about
the same time.

Nizar claims
he is still
Perak Mentri Besar.

So he is still
using the official residence
and official new Toyota Camry car.

Though ordered
by Perak Sultan Azlan Shah
to go
with his exco members,
he is staying put
where he is.

He states
he is the legitimate
Perak Mentri Besar
and Zambry is "illegal".

This is because
he has not quit
with no due legal
process to remove him
at proper formal sitting
of Perak State Asssembly
where no confidence vote
has to be tabled and passed
against his leadership.

Zambry has no alternative
but to operate from
his own house.

At the special exco meeting,
Nizar and exco members
extended industrial plots
land lease from present
30-60 years to
99 years.

They also approved 342 new councillors
for Perak's 15 local councils.

They revived Ipoh airport
for use by low-cost carrier
Firefly
to operate flights
to Singapore and Subang.

Nizar stresses
he would report
for work again
next Tuesday
(February 10,2009)
as Tuesday is
his Mentri Besar
meet the people
weekly session.

Meanwhile,
police reports
have been lodged
against Nizar
and People Alliance
leaders for questioning
the rights of
the Malay rulers
by United Malays National Organization
(UMNO) leaders.

The UMNO leaders
including UMNO vice-president
Tan Sri Muhyiddin Yassin
criticized People Alliance
leaders for disrespect
of the Perak sultan.

They claimed
Nizar could be charged
under Sedition Act for
refusing to follow
the ruler's order.

DAP Chairman
Karpal Singh's threat
to file legal suit
against the sultan
to remind him
to comply with
Perak Constitution
was described by
Muhyiddin as
"act of treason".

Perak political temperature
hots up with
Malaysia's former Prime
Minister Tun Dr. Mahathir Mohamad
joining the fray.

Mahathir,famous
for curbing the excesses
of royalty and exercise
of royal assent,
states tongue in cheek
that many Malays
are supporting Karpal
but "Inilah Melayu moden,
saya ni orang tua (These are
modern Malays, I'm just an old man)".

He stresses
Perak State Assembly
should have met and decided
on a vote of no confidence
against Nizar
as "this is the only way
to bring down a government".

He adds "nothing can obstruct
a person from suing" the sultan
but ethically, "it is not good".

In his personal blog,
Mahathir asks
whether UMNO
is "so desperate"
as to get the support
of two of the three defectors ~
Jamaluddin Mohd(Behrang)
and Mohd Osman Mohd Jailu (Changkat Jering)
~ as the duo are facing
corruption charges
in court
linked to land development.

Amid the brewing controversy,
National Front faces
tough political act.

Already,nine protestors
have been arrested by police
for alleged rioting
at mass public outrage
to block swearing in
of Zambry at Perak's royal town,
Kuala Kangsar,two days ago.

Perak UMNO
and 12 Malay NGOs
are also gearing up
to organize counter protests
with yellow armbands
as sign of loyalty
to show appreciation
and loyalty to
Perak ruler.

Now National Front
holds political dynamite
with almost all Malay
Perak government face.

All,except one, Dr.Mah Hang Soon
(BN-MCA - Chenderiang),of
its 28 state assemblymen are Malays
in multi-racial Perak.

There is no Indian state assemblyman
in its Perak line-up.

This is in sharp contrast to
People Alliance multi-racial
representation with Perak
State Assembly Speaker
V.Sivakumar.

All Indian representatives
put up by National Front
via Malaysian Indian Congress(MIC)
in Perak were defeated in
historic political tsunami
at March 8,2008
General Election.

People Alliance
then captured
five out of 13 states
of Malaysia.

National Front
lost its two-third
majority in
Malaysia's Parliament
50 years after Independence
on August 31,1957.

The disastrous defeat
and losses in the five states
precipitated UMNO leaders'
pressure on Prime Minister
Datuk Seri Abdullah Ahmad Badawi
to step down next month
ahead of his earlier planned
exit.

MIC President S Samy Vellu
also lost his Sungei Siput safe
parliamentary seat in Perak
in massive people power
backlash over five Hindraf
leaders' detention without trial
under draconian
Internal Security Act(ISA).

At its last sitting
on November 14,2008 at 4 pm,
the Perak State Assembly
had passed motion
calling upon the
Federal Government
to abolish the ISA
and free all detainees
at Kamunting detention centre
located in Taiping, Perak.

National Front
has lost further
public support
in two by-elections
in Permatang Puah
and Kuala Trengganu
since the March 8 debacle.

Now with
the Perak Constitutional Crisis
steaming hot
with public outrage,
Perak state government
is world's big laughing stock
as two rival political state chiefs
~ one newly sworn in and the other
ousted but crying foul ~
claim legitimacy
of their leadership.

So Dummies,
hold on to your seats to
watch more stirring scenes
and seething waves of protests
as hung Perak State Assembly
of 28 National Front
versus
28 People Alliance
state assemblymen
slug it out
with three unreliable
independent defectors
holding disputed seats
and the balance of power.

What is the moral?

"Toppling an elected
popular government
is no simple frog
hop party play.

Losing the people
trust is worse then
winning the sultan
consent."

Perak Constitutional Crisis

Perak Constituional Crisis
brews as furious citizens
condemn new state government
as unconstitutional and illegal.

Yesterday(February 6,2009),
Perak opened a new
historic chapter of political
fury.

Riot police fired tear gas to
disperse hundreds of angry
protestors as they marched to
Istana Iskandariah in Perak's
royal town, Kuala Kangsar
to block
the swearing in
of a new Perak
Mentri Besar( Chief Minister or
State Governor).

But their attempt
proved futile.

At 4.02pm,
Datuk Dr.Zambry Abdul Kadir
(BN - Pangkor)
was sworn in
as the 11th Mentri Besar
of Perak before
Perak Sultan Azlan Shah,
witnessed by Perak royalty
and National Front leaders
led by
Prime Minister-designate
Datuk Seri Najib Tun Razak.

All 28 People Alliance
state assemblymen led
by ousted Mentri Besar
Datuk Mohammad Nizar Jamaluddin
boycotted the event.

Nizar,instead, reported
for work as usual
in his official car together
with his state executive council members.

But he had to
eat humble pie.

At the gate
he asked for permission
from the security guard
to allow him access
to his office.

At his office
he found all his
personal belongings
gone.

He pulled out
an empty drawer
where he had kept
his things.

To add insult
to injury,
the State Secretary
Abdul Rahman Hashim
interrupted Nizar twice
as he tried to hold
a press conference.

Nizar, his aides
exco members and
reporters were all
escorted out by police.

Perak State Assembly Speaker
V.Sivakumar also personally
delivered an official letter to
the palace seeking the
Perak sultan's consent
to convene an emergency sitting
of the Perak State Assembly.

He also took the precaution
to fax a copy of the letter at 1.30pm
yesterday to
Istana Kinta,the Perak ruler's
official palace in Ipoh.

Nizar,burning with fury,
vowed to fight it out
and sue the "illegal"
new Mentri Besar for
taking over the Perak
government without
proper due process.

He would not
quit unless a clear
vote of no eonfidence
to remove him
has been lawfully
tabled and passed
at the Perak State Assembly.

His refusal to quit
and Datuk Dr.Zambry
swearing-in to take his post
means Perak is now
deep in constitutional crisis
with two Mentris Besar(Chief Minsters
or State Governors)!

Now how ~ Perak has
unprecedented two heads of government ~
one just sworn in and the other
ousted and crying foul.

This is because both National Front
And People Alliance command equal
numbers ~ 28 seats each in the hung
Perak State Assembly.

National Front claims it has the "majority"
of three disputed seats of three defectors
who have swung their allegiance from
People Alliance to National Front
in a Perak political coup.

Sivakumar has already filed a legal
suit at the High Court
to declare the three state seats
vacant
and
resignations of the defectors
valid.

The decision by Perak Sultan Azlan Shah
not to consent to advice of his Mentri Besar
Nizar to dissolve the hung Perak State Assembly
and call for fresh elections
is under hot dispute.

The validity of  the sultan's dismissal of Nizar
and his state exco members
is being questioned in law.

In a special press statement,
United Malays National Organization(UMNO)
elder statesman and Malaysia's Former
Finance Minister Tengku Razaleigh Hamzah
stresses that Nizar is still the
Perak Mentri Besar!

Tengku Razaleigh says Nizar
is not the Mentri Besar until
he resigns or is defeated
in a vote of no confidence
at a formal sitting of the
Perak State Legislature.

"To formally test the mandate
of the current government,
the question must be put to
the people through state elections,
or to the assemblymen through
a formal vote in the Dewan(Perak State Assembly),"
he points out.

"To remove and install
governments in any other way
is to violate the Constitution,
erode the rule of law and
run the risk of forming
an illegal government,"
he adds.

Tengku Razaleigh,Malaysia's
longest-serving
Member of Parliament,
advises that a legitimate government
draws its authority
from the consent of the people
and only from that consent.

"The people consent because
it is their government formed
according to their constitution.
whose leader is chosen through
free and fair election,"
he reasons.

So,in the public eye,
Nizar is still the Perak Mentri Besar.

His political mentors
at the People Alliance
leadership council has
mobilized resources with
a team of top lawyers
to challenge the toppling
of the opposition-led
People Alliance Perak government
by "unconstitutional and illegal"
means.

People Alliance leaders
-PKR leader former Prime Minister
Datuk Seri Anwar Ibrahim.
PAS President
Datuk Seri Abdul Hadi Awang,
DAP Chairman Karpal Singh
and
DAPAdviser Lim Kit Siang ~
held emergency meetings
and decided to appeal
to the Perak sultan
to review his decision,
failing which legal suits
would be filed against
the sultan and National Front
for "power grab"
ultra vires
the Perak Constitution.

So Dummies,
who is right
who is wrong
in this new Perak
political power play?

Mark Twain would
have laughed aloud
over the political antics,
especially the height,
distance and speed
that Perak political
frogs
have achieved
in order to topple
Perak state government.

They set a historic record
in Perak for
political skulduggery.

Well, bear in mind
always this famous qoute
of Lord Acton (1834-1902):
"Power tends to corrupt
and absolute power corrupts
absolutely."

Malaysia's
prime minister-designate,
outgoing prime minister,
Perak sultan
and others have put up
a fantastic froggy fuzzy
political power drama.

They have put
their fingers and stirred
a right royal pudding.

To the winning side,
the pudding looks
delicious.

To the losing side,
it seems so
bitter.

But good or bad
~ all things must end
well.

The sultan
has exercised
his royal prerogative.

The people
need to exercise
their right to
a government of their
choice.

Better Dummies
to use your understanding
to reason
and pick
real good state assemblymen
able to execute
the public trust
to speak out
and act responsibly
dutifully and faithfully
to safeguard
the public interest.

I would like
to kick the wrong
representatives
in the butt
and see how
they jump as frogs
and fire them
with my vote.

What is the moral?

To rule right is hard,
to do wrong is easy.
